1. Agreement
These Terms are between you and Bananote, LLC ("we," "us," or "our"), the developer of Spiel. By downloading, purchasing, installing, or using Spiel, you agree to these Terms. If you do not agree, do not use Spiel.
If you downloaded Spiel through the Apple App Store, Apple's Standard EULA applies to that copy of the app.
2. License and use restrictions
Subject to these Terms, we grant you a personal, limited, non-transferable license to use Spiel on supported devices. Any device limit or license tier is the one shown at purchase.
You may not resell, redistribute, sublicense, reverse engineer, attempt to extract source code, misuse license keys, bypass access controls, or use Spiel unlawfully.
3. Intellectual property
Spiel, including its software, design, user interface, and branding, is owned by Bananote, LLC and its licensors and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you in these Terms are reserved.
Your license to use Spiel does not give you any right to use our name, logos, or trademarks, or to copy, modify, or reuse any part of Spiel except as needed to use the app normally.
You keep all rights to the text you dictate and the notes you create with Spiel. We do not claim ownership of your content.
4. Billing
Website purchases are processed by Polar and its payment partners. App Store purchases are processed by Apple. The provider that processes your purchase handles payment, tax, receipt, refund, and checkout information under its own terms and policies.
Refund requests must be made through the provider that processed the purchase. Keep your license key private. For direct purchase, license key, or activation help, contact [email protected].
5. Disclaimers and limitation of liability
No warranties: The services are provided "as is" without warranties of any kind. We do not guarantee that the services will be error-free or uninterrupted.
Speech-to-text output can contain mistakes. You are responsible for reviewing and editing text before relying on it, sending it, publishing it, or using it in important contexts.
Limitation: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or in connection with your use of the services.
6. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules.
